B2B SaaS Relationship

LoanX provides a platform that lending agencies (our customers) and their authorized users (e.g., loan officers, staff) use to manage borrower information, facilitate credit checks, and originate loans. In many cases, these lending agencies are the data controllers or “businesses” responsible for determining how personal information is processed. LoanX typically acts as a data processor or “service provider” that processes information on behalf of these lending agencies.

Borrower Interactions

Borrowers may also choose to share data with LoanX directly, for example by entering details into our applications or by authorizing third-party data checks. This Privacy Policy applies to any such direct interactions.

Excluded Data Subjects

This Privacy Policy does not apply to:

  • Job applicants and candidates for employment with LoanX.
  • LoanX employees and non-employee workers.
  • Any personal information we process solely on behalf of our customers under separate data protection agreements, to the extent that the customer is the primary controller.

    3. User-Generated Data: Information provided or entered by lending agencies’ authorized users or by borrowers themselves, including documents uploaded to our platform.
    4. Technical Information: IP address, browser type, device information, cookies, and usage analytics to improve our services.
    5. Communications: Recorded or AI-parsed transcripts from conversations between borrowers and lending agents, if applicable.
    6. Third-Party Data: With borrower authorization, data obtained from external services (e.g., credit check providers, verification of assets/liabilities) that help in underwriting, title search & insurance, or loan origination.

    1. Platform & App Entries: Borrowers and lending agency users may enter information directly into our platform.
    2. Recorded Conversations & Voice Fingerprinting: Conversations with loan officers or borrowers may be recorded, and AI systems may parse transcripts to extract data. We create and store voice fingerprints to identify speakers, improve data extraction, record consent, and assign tasks to the correct individuals.
    3. Manual Data Entry by Lending Team: Loan officers or staff may input borrower details as part of normal business processes.
    4. Third-Party Integrations: We request and receive data from authorized third-party services (e.g., Credit Reporting Agencies, Verification of Assets [VOA], Verification of Liabilities [VOL]) to facilitate loan evaluations.

We use the information we collect for the following business purposes:

    1. Providing Services to Our Customers: Facilitating loan origination, processing borrower data, and storing documents on behalf of lending agencies.
    2. Voice Identification: Using voice fingerprints to accurately identify speakers during calls or recordings, support data extraction, capture consent, and streamline task assignment.
    3. Compliance & Security: Complying with legal obligations, preventing fraud, and maintaining data and platform security.
    4. Platform Improvement & Analytics: Monitoring platform performance, diagnosing issues, analyzing trends, and improving user experience.
    5. Customer & User Support: Communicating with lending agencies, real-estate agents, and borrowers regarding questions, updates, or technical issues.
    6. Email and SMS Communications: From time to time, We may send communications (including emails and SMS messages) to borrowers using the contact information collected during the loan application process. Borrowers consent to receiving these communications for purposes related to their loan application or account.
    7. Marketing Communications: With appropriate consent, sending updates or promotional materials about our services.

  1. Legal Bases for Processing

When acting as a data processor/service provider, our legal basis for processing personal information (including voice fingerprints) derives from our contractual obligations to our customers (the lending agencies). If we collect and process information directly from borrowers, we may rely on consent, contractual necessity, or other lawful bases as required.

LoanX does not sell or rent personal information. We may share information under these circumstances:

  • At the Direction of Lending Agencies: We share borrower data as instructed by the lending agency controlling the data.
  • Service Providers: We use vetted third-party vendors to support functions like identity verification, credit checks, data storage, and document processing.
  • Regulatory Authorities: Where required by law or legal process, such as to comply with subpoenas, court orders, or other lawful requests.
  • Advertising & Analytics Partners: We may share technical or aggregated data for analytics or marketing purposes, but not borrower-specific personal information without proper authorization.
